Initiating a guardianship or conservatorship in Michigan involves filing a petition with the probate court. A hearing is scheduled, and notice must be given to all interested parties. The court may appoint a guardian ad litem to represent the interests of the alleged incapacitated person. Medical evaluations are often required to assess the individual's capacity. If contested, the case may proceed to trial, where a judge will determine the necessity of the guardianship or conservatorship.
