The probate process begins by filing a petition with the county probate court to appoint a personal representative (executor). After the court validates the will (or determines intestate succession if no will exists), the representative gathers assets, notifies creditors, pays debts and taxes, and distributes the remaining property to heirs or beneficiaries. This process can take several months to over a year, depending on the complexity of the estate.

When disputes arise, probate litigation may become necessary. The litigation process typically includes pleadings, motions, and hearings. We help clients manage these conflicts by striving for resolution but are fully prepared to advocate in court when needed.
