CHILD SUPPORT

Child support exists to make sure that children continue to receive consistent and reliable financial support from both parents, even after a separation or divorce. It is intended to provide for a child’s essential needs—such as housing, food, clothing, education, and healthcare—and to preserve, as closely as possible, the standard of living the child would have enjoyed if both parents lived together.

In Michigan, child support is calculated using the Michigan Child Support Formula, which is applied through specialized software to ensure fairness and consistency across cases. The formula takes into account both parents’ incomes, the number of overnights each parent has with the child, and additional costs such as health insurance premiums, child care, education, and extraordinary medical or extracurricular expenses. While the formula produces a presumptive support amount, the court may deviate from that amount when special circumstances exist, such as a child with special needs, significant income disparities between parents, or other unique financial considerations.

Child support orders can be modified when life circumstances change. A substantial change in income, employment, health, or parenting time may justify an increase or decrease in the amount of support. The court can review and adjust support obligations to ensure they remain appropriate over time. Enforcement mechanisms are also available when a parent fails to comply with a support order; these may include wage garnishment, income withholding, tax refund interception, contempt proceedings, or liens on property.
