SPOUSAL SUPPORT

Alimony, also known as spousal support, is the financial support paid by one spouse to the other after divorce. It is designed to reduce economic disparities between spouses and help both parties maintain a reasonable standard of living after the marriage ends. Courts award alimony to promote fairness and stability during the transition to post-divorce life, taking into account the individual circumstances of each marriage.

There are several types of alimony, each serving a different purpose. Temporary alimony provides financial assistance during the divorce process. Rehabilitative alimony is typically short-term and intended to help a spouse gain education, training, or employment skills needed to become self-sufficient. Permanent or long-term alimony may be granted when one spouse cannot reasonably become self-supporting due to factors such as age, health, or the length of the marriage.

When determining whether alimony is appropriate and, if so, how much should be awarded, courts consider a variety of factors. These include the standard of living established during the marriage, the duration of the marriage, the income and earning capacity of each spouse, and their respective ages, health, and educational backgrounds. The court also examines each party’s contributions to the marriage—both financial and non-financial—such as serving as a homemaker or supporting the other spouse’s career. Additionally, the care of minor children and any custodial responsibilities can influence the amount and duration of support.

Alimony orders are not necessarily permanent and may be modified if there is a substantial change in circumstances, such as a loss of employment, retirement, or a significant shift in income. Failure to comply with an alimony order can lead to enforcement measures, including contempt proceedings or wage garnishment.
