MEDIATION IN DIVORCE
Mediation is a voluntary and collaborative process in which a neutral third party, known as the mediator, helps individuals resolve disputes without going to court. It is particularly effective for family law matters such as divorce, custody, parenting time, and support. Mediation offers a structured but flexible setting that allows parties to express their concerns, clarify priorities, and work toward mutually acceptable solutions with the mediator’s guidance.

During mediation, both parties may meet jointly or separately with the mediator to discuss the issues in dispute. The mediator facilitates communication, helps identify areas of agreement, and encourages productive problem-solving. While the mediator does not make decisions or impose outcomes, their role is to guide the parties toward a voluntary resolution that reflects their shared goals. Any agreements reached through mediation are documented privately and, when appropriate, submitted to the court for approval and entry as binding orders.

Mediation offers several advantages over traditional litigation. It allows parties to maintain control over the outcome and craft customized solutions that best fit their family’s needs. The process is confidential, keeping sensitive personal and financial matters out of the public record, and it is often significantly less expensive and time-consuming than court proceedings. Most importantly, mediation fosters cooperation and reduces adversarial conflict, which can be especially beneficial when children are involved.
However, mediation requires both parties to engage in good faith and communicate openly. Because participation is voluntary, the mediator cannot compel agreement, and if discussions break down, the case may proceed to litigation. In some instances—such as those involving domestic violence or severe power imbalances—mediation may not be appropriate.
