CONTESTED DIVORCE

While many divorces can be resolved through negotiation or mediation, some situations require the intervention of the court to reach a fair and enforceable outcome. When disputes arise over critical issues such as child custody, asset division, or spousal support, a contested divorce—also known as a divorce trial—may be necessary. Trial becomes the right choice when negotiation fails, when one party refuses to act in good faith, or when complex disputes involving children or significant assets cannot be resolved through other means. It is also appropriate when a legal precedent or a clear judicial ruling is necessary to protect long-term rights.

A contested divorce involves several key stages, beginning with careful preparation and discovery. During this phase, both parties gather and exchange evidence such as financial records, expert reports, and witness testimony to build a complete picture of the marital estate and the issues in dispute. Pretrial motions and hearings may follow to resolve evidentiary matters, establish temporary orders, or address procedural questions. The court will hear from witnesses, including the parties themselves, and often from experts such as forensic accountants, child psychologists, or business valuation specialists. After the trial, the judge issues a decision. Post-trial motions or appeals may follow if either party challenges the court’s ruling.
